Check Bounce Cases: The Supreme Court has taken cognizance of the ever-increasing cases of check bounce. On behalf of the top court, it has been ordered to constitute special courts in five states for this. These courts will be started after 1st September 2022.
Check Bounce Cases: There are already very strict rules from the side of the court when the check bounces. Now if your or any of your relative / friend’s check bounces, then it is not good. Now the Supreme Court has directed the formation of special courts with retired judges in five states from September 1 for speedy disposal of check bounce cases.
Special courts to be set up
Justice L. Nageswara Rao, Justice BR Gavai and Justice S Ravindra Bhat said that in view of the large number of pending cases in Maharashtra, Delhi, Gujarat, Uttar Pradesh and Rajasthan, special courts will be constituted under the Negotiable Instruments Act.
Special courts will start after 1st September 2022
The bench also said, ‘We have incorporated the suggestions of the amicus curiae regarding the constitution of pilot courts. For this we have also given a time limit. It is to start from 1st September 2022 onwards. The bench said that the general secretary of the court will decide whether the copy of the present order should be sent directly to the registrar general of these five high courts, who can produce it before the chief justices for immediate action.
Affidavit to be filed by 21st July 2022
The Supreme Court directed its General Secretary to inform the Registrar General of the High Courts of these states about this order. Along with this, he has been directed to file an affidavit by 21 July 2022 on compliance of this order. Significantly, the amicus curiae suggested that as a pilot project, there should be a court with retired judges in every district.
Now the hearing on this matter will be held on July 28. Taking cognizance of the pendency of a large number of check bounce cases, the Supreme Court had directed for immediate disposal of such cases. As of 31 December 2019, such cases were 35.16 lakh.
