The Luthra brothers are officially back on Goa soil. And then a Delhi court handed them over to local authorities on Tuesday, granting a 48-hour transit remand to ensure they face the music for the “Birch by Romeo Lane” tragedy.

The owners, Saurabh and Gaurav Luthra, were whisked away from Delhi’s IGI Airport early Wednesday morning. This happened after they were deported from Thailand and immediately arrested upon landing in India.

The Legal Maneuvers

The brothers tried to avoid this immediate hand-over, but the court wasn’t having it.

  • Transit Remand Granted: Duty Magistrate Twinkle Chawla approved a two-day window for the Goa Police to transport the duo. The police actually asked for three days, but the court capped it at 48 hours.

  • Medical Orders: The court acknowledged the brothers’ medical needs, ordering the police to provide their prescribed medicines and necessary care during the journey.

  • Flight from Justice: Here’s the kicker: investigators found the brothers booked their tickets to Phuket just one hour after the fire started on December 6. The court called this a clear attempt to “evade the legal process.”

The Charges and Evidence

The case against them is heavy, or nothing. They are facing charges under the Bharatiya Nyaya Sanhita (BNS), 2023, including Section 105 (culpable homicide).

  • The Firework Event: Police say the blaze was sparked by a “firework event” or pyrotechnic display organized without any proper safety gear.

  • Structural Lapses: Preliminary probes show the club lacked emergency exit doors on the ground and deck floors. Let’s be real, it was a death trap.

  • Missing Documents: The thing is, key documents like licenses, internal communications, and event permissions are still missing. Police need the brothers in custody to unearth the full “conspiracy” of negligence.

What’s Next?

The brothers arrived at Manohar International Airport in Mopa around 10:45 AM today. They are expected to be taken to the Anjuna police station for intense questioning before being produced in a Mapusa court for a regular police remand.

Meanwhile, the Bombay High Court has stepped in, turning the case into a Public Interest Litigation (PIL) to fix the “systemic failures” that allowed such a dangerous venue to operate in the first place. This story isn’t ending anytime soon.
