Now the Supreme Court has intervened in a harrowing case of institutional failure. On Monday, March 23, 2026, a bench headed by Chief Justice Surya Kant slammed the Gurgaon police for their “insensitive” conduct. The court was hearing a plea regarding the brutal rape of a three-year-old girl in a high-rise condominium. Therefore, the top court has summoned the Gurgaon Police Commissioner to appear in person this Wednesday.

The “Metro City” Failure: CJI’s Stern Remarks

Now the Supreme Court has expressed disbelief at the state of law enforcement in a major metropolitan hub. Chief Justice Surya Kant questioned how the police could be so callous in such a sensitive case. Therefore, the bench noted that the basic duty to register an FIR upon disclosure of a serious offence was ignored.

“How can the police be so insensitive in a so-called metropolitan city?” the CJI asked. First, the court noted that arrests were only made after the matter was mentioned in the Supreme Court. Next, the bench highlighted that the crime scene had not been secured for over a month. Thus, the integrity of the evidence is now in question.

Allegations of Coercion and Bribery

Now the details of the investigation have raised even darker concerns. Senior advocate Mukul Rohatgi, appearing for the victim’s parents, informed the bench of systematic harassment. Therefore, he alleged that the woman investigating officer (IO) was pressuring the family to withdraw the case.

First, it was revealed that the initial IO in the case had been suspended for taking a bribe in a separate POCSO matter. Next, the current IO reportedly irritated the family when they requested a home visit for the traumatized child. Thus, the family was forced to shuttle between the police station and the hospital repeatedly.

 

Magistrate Under Fire for Procedural Lapses

Now the judicial handling of the case is also under the scanner. The court was “disturbed” by how the three-year-old’s statement was recorded. Therefore, the bench has directed the Gurgaon District and Sessions Judge to seek an explanation from the concerned magistrate.

According to the plea, the magistrate recorded the statement while the accused were standing in the same room. Under the law, any proximity between the accused and a minor victim is strictly prohibited. Furthermore, the magistrate reportedly told the toddler five times to “speak the truth.” So the bench noted that such conduct lacks basic legal and emotional sensibility.

The Demand for a CBI or SIT Probe

Now the parents of the victim are losing faith in the local authorities. They are seeking a probe by the Central Bureau of Investigation (CBI) or a court-monitored Special Investigation Team (SIT). Therefore, the Supreme Court has issued notices to the Haryana Government and the DGP.

“A message must go from the highest court of the country,” Rohatgi argued. Currently, three individuals have been arrested, including domestic helps. However, the parents believe the “shoddy” local investigation might protect more influential parties. Meanwhile, the court is considering appointing senior women IPS officers to lead a new probe.
