Tribunal said – retirement age should be 65 years

There is a demand to increase the retirement age of principal employees by 3 years in Maharashtra. For this a petition was first filed in the Tribunal Court. The notice to retire at the age of 62 was challenged by the petitioner through advocates Ravi Pandey and Sudam before the University and College Tribunal in the city. After which the tribunal while answering the question in favor of the petitioner said that AICTE is the only authority. Therefore the retirement age of the principal should be 65 years.

High Court’s big decision

However, on the order of the tribunal, the employer Vidarbha Youth Welfare Society challenged this decision before the Nagpur bench of the Bombay High Court through advocate Siddhesh Kotwal. The High Court, while allowing the petition, had said that the age of retirement should be as per G.O. The retirement age of professor in GO has been fixed at 62 years. In such a situation, it was decided to increase the retirement age of the principal to 62 years.

Challenging the decision by filing a special leave petition in the Supreme Court
Now the decision of the Nagpur High Court has been challenged in the Supreme Court by Mir Sadiq Ali by filing a Special Leave Petition. Now the issue will be examined by the Supreme Court whether the retirement age of the principal will be 65 years as per AICTE rules, it will remain fixed at 62 years as per the Maharashtra government’s resolution? Right now, in this matter, a bench of Justice Hima Kohli and Justice Rajesh Bindal has issued a notice and has stayed the effect and implementation of the High Court’s decision.

At the same time, according to the decision of the Supreme Court, there can be an increase in the retirement age of the employees. However, according to the GO of the Government of Maharashtra, the Supreme Court can also decide to keep the retirement age of the employees at 62 years, going along with the decision of the High Court.
