For this, the High Court has given the state government 3 months time. The Punjab-Haryana High Court has termed as erroneous the order of the Punjab Government in which the employees were entitled to only basic pay for the probation period of 3 years.

Salary payment orders within 3 months

The High Court heard the matter and while giving relief to the employees, ordered the state government to pay the deducted amount within three months to the employees from whose salary the allowance was deducted.

The High Court has considered the employees who have served under the Probation Rule in the Punjab Government as eligible for the benefit of deducted allowance and has ordered the Punjab Government that these employees will have to pay their deducted allowance to the Punjab Government within three months. .

Cannot deprive employees of benefits

While giving its verdict on 102 petitions, the High Court said that this notification has already been rejected by the Punjab-Haryana High Court. The Punjab Government has challenged that order in the High Court and the Rajasthan Government has also taken an appeal in the High Court against a similar order through SLP.

The Supreme Court has issued notices on the petitions of both the Rajasthan Government and the Punjab Government, but has not stayed the order of the High Court in any case, so the employees cannot be deprived of their benefits. Along with this, the court held that the date of commencement of service of the employee should be considered from the date of appointment.
