Sentenced to six months in prison

A Delhi woman has been sentenced to six months in jail for not filing income tax returns on income of Rs 2 crore. This decision has come on the complaint of Income Tax Office (ITO). The Income Tax Department claimed that out of the Rs 2 crore received by the woman in the financial year 2013-14, Rs 2 lakh was deducted as TDS. Despite this, the woman did not file any income tax return in the assessment year 2014-15.

One month additional jail for not paying the fine

According to the news published in Times of India, the court of Additional Chief Metropolitan Magistrate Mayank Mittal, after hearing the entire case, has sentenced the Savitri Nak woman. The court said in its order, ‘The guilty woman is sentenced to six months in jail.

Along with this, the court also imposed a fine of Rs 5,000 on the woman. If the woman does not pay the fine amount, she will have to spend one more month in jail. The court has granted 30 days bail to the woman to challenge the decision.

Gave 30 days bail to appeal.

Savitri’s lawyer argued that she is an illiterate widow. There is no one to help them. After hearing the arguments, the court granted 30 days bail to appeal against the decision. The court also held that the complainant Income Tax Department was not successful in proving that notices were sent to Savitri to file Income Tax Return (ITR). The court said in its decision that Savitri did not fulfill her responsibility.

The court wrote in its decision that the accused woman is considered guilty under section 276CC for 2014-15 for not filing income tax return. He is punished for an offense punishable under section 276CC. Income tax returns are filed by the Income Tax Department to keep people informed about their earnings and to check the tax on their earnings. The last date for filing returns is usually 31st July.
