The secretariat announced that Congress leader Rahul Gandhi is no longer a member of Parliament after being convicted and sentenced by Gujarat’s Surat court in a defamation case in 2019.

According to NDTV, regarding this whole matter, senior advocate and Rajya Sabha MP Kapil Sibal says, “If it (court) only suspends the sentence, it will not be enough. There should be a stay on suspension or conviction. He (Rahul Gandhi) can continue as a Member of Parliament only if there is a stay on the conviction.” If the High Court does not cancel the decision, then Rahul Gandhi will not be allowed to contest elections for the next 8 years.

Rahul Gandhi can now challenge this decision in the court. At the same time, Congress leaders questioned the legality of the move, saying that only the President can disqualify MPs in consultation with the Election Commission. According to Rahul Gandhi’s team on this matter, preparations are being made to challenge this decision in the High Court. If the appeal for suspension of sentence and stay on the order is not accepted there, they will approach the Supreme Court.
Experts say that under the Representation of the People Act, MPs or MLAs can avoid disqualification only after the punishment is suspended and the conviction is stayed. An expert said that any public representative will automatically be disqualified if sentenced to two years or more. Yes, if the sentence is suspended on appeal, then the disqualification will automatically be suspended. If this does not happen, then after serving the sentence, the disqualification period is 6 years. Means it is a question of 8 years.
